Introduction

This Privacy Policy ("Policy") describes the policies and procedures of FengshuiFans LLC and its affiliates and subsidiaries (collectively, "we," "us," or "the Company") regarding the collection, use, disclosure, and sharing of your personal information when you use our Platform. Capitalized terms not defined in this Policy have the meanings given to them in our Terms of Service.

The Company is the data controller of your personal information and is responsible for providing this Policy to you.

Our servers are located in the United States. If you access the Platform from the European Economic Area (EEA), the United Kingdom, Switzerland, or other regions with data transfer restrictions, your personal data may be transferred to and processed in the United States. Please see Section XII (Supplemental EEA+ Privacy Statement) and Section XIII (Supplemental U.S. Privacy Statement) for region-specific disclosures.

Please read this Policy carefully and in full before using or continuing to use our Platform. If you do not provide certain personal information to us, we may not be able to provide the Platform Services to you, or use of certain features may be restricted.

I. How We Collect and Use Your Personal Information

FengshuiFans.com is an online community and learning platform dedicated to feng shui. Users can share knowledge, publish content, and interact based on shared interests. We collect and use personal information you voluntarily provide or that is generated during your use of the Platform, in accordance with the principles of legitimacy, legality, and necessity, for the purposes stated in this Policy.

If we intend to use your personal information for purposes not stated in this Policy, we will inform you in a reasonable manner and obtain your consent before doing so.

1. Account and Profile Information

When you create an account and profile on the Platform, we collect your name, email address, and other information you provide, such as topics you are knowledgeable about or interested in. Your email address is used for authentication, account security, service notifications, newsletters, and membership reminders, and will not be publicly displayed to other users. You may manage your email preferences in your account settings at any time. You may optionally add a photo, country of residence, educational background, and other profile details. Once your profile is created, other users may view certain activity information associated with your account on the Platform.

2. Your Content

We collect content you publish on the Platform, including posts, comments, images, and edit histories. Your content, timestamps, and associated comments will be publicly visible on the Platform. Your content may be indexed by search engines and reproduced on the internet in accordance with our Terms of Service.

3. Communications

When you communicate with us by email, through the Platform, or by other means, we retain records of those communications. The Platform provides a messaging feature that allows you to send private messages to other users. We store these communications and associated information, such as the date of communication and the recipient.

4. Third-Party Account Login

You may log in to the Platform using your Google account, WeChat account, email verification code, or SMS verification code. By doing so, you authorize us to collect and process the name and email address associated with your third-party account for the purpose of authentication. For email login, we collect your email address for verification and the notification purposes described above. For SMS login, we collect your phone number solely for verification purposes. Please note that your activities and personal information on third-party platforms are subject to their own terms of service and privacy policies.

5. Cookies and Similar Technologies

We use only essential cookies necessary for the operation of the Platform, such as session authentication cookies. We also use Cloudflare Turnstile for bot protection, which may collect your IP address, browser type, and interaction patterns. We do not use analytics, advertising, or tracking cookies. You have the right to accept or decline cookies by modifying your browser settings. However, if you decline cookies, you may be unable to log in or use certain Platform features that rely on cookies.

6. Billing and Payment Information

If you become a paid creator or make purchases on the Platform, we will collect relevant billing and payment information. Full payment card details are processed by our third-party payment processor and are not stored by us.

7. Platform Usage Data

We collect Platform usage and browsing information, including IP address, timestamps, user agent, cookie IDs, URLs visited, content identifiers, timezone, and other activity information.

How We Use Your Information and Our Legal Bases for Processing

We use the information we collect for the following purposes. Where required by applicable law (including the GDPR), we rely on the legal bases indicated. You may choose not to provide personal information, but doing so may affect our ability to provide certain services to you.

Providing the Service: To provide Platform Services to you, make the Platform publicly available, respond to your inquiries, and provide troubleshooting and customer support. Legal basis: performance of a contract with you.

Personalization: To recommend content, accounts to follow, and customized features based on your interests and behavior. Legal basis: our legitimate interest in providing a personalized experience.

Billing and Payments: To process fees and make payments to service providers and content creators. Legal basis: performance of a contract with you.

Marketing and Promotions: To send you news, offers, and promotional information. We will seek your consent where applicable, and you may unsubscribe at any time.

Facilitating Communications: To facilitate your communications with us and with other users. Legal basis: performance of a contract with you.

Analytics: To collect analytics data to understand how users use the Platform, improve Platform features, and develop new products. Legal basis: legitimate interest in improving our services.

Legal Compliance: To comply with legal obligations and for general business and administrative purposes.

Fraud Prevention and Security: To investigate, prevent, or address illegal activities, suspected fraud, potential security threats, or violations of our Terms of Service.

II. How We Share, Transfer and Publicly Disclose Your Personal Information

We share your information as described below, or when requested or consented to by you.

1. Sharing

We will not share your personal information with any company, organization, or individual except in the following circumstances:

(1) Service Providers: We share your information with third-party service providers who use it to provide services to us, such as payment processing, hosting, and customer service. Our primary service providers include Cloudflare (security and bot protection), Vultr (cloud hosting), Stripe, PayPal, and WeChat Pay (payment processing), Google and WeChat (third-party authentication), and Zoho Mail (transactional and notification emails).

We use Cloudflare Turnstile for bot detection and anti-abuse protection. Turnstile may collect your IP address, browser type, and interaction patterns to determine whether a visitor is a real user. This processing is based on our legitimate interest in maintaining platform security. For more information, please refer to the Cloudflare Privacy Policy.

(2) Affiliates: Your information may be accessed or shared with affiliates of the Company, whose use and disclosure of your personal information is subject to this Policy.

(3) Business Transfers: In connection with a merger, asset sale or transfer, business acquisition or reorganization, bankruptcy, or similar event, we may disclose or transfer your information to a successor entity.

(4) Legal and Rights Protection: Where required by law, or where we believe it is necessary to respond to claims against us, comply with legal process, enforce or administer the terms of agreements, prevent fraud, or protect the rights, property, or safety of our users or others.

(5) Your Content and Public Information: Your content, including your name, avatar, profile, and certain activity information, is accessible to other users and may be publicly viewable by non-registered visitors. Your content may be indexed by search engines.

(6) Platform Usage Information: We may share aggregated and anonymized usage statistics for platform analytics purposes.

(7) Research: We may share aggregated or anonymized information with third parties for market research, reporting, and analysis. Such information cannot be used to identify individual users.

2. Transfer

We will not transfer control of your personal information to any other company, organization, or individual without your express consent, except: (1) with your prior consent; (2) at your request; (3) in the event of a merger, division, dissolution, or bankruptcy of the Company; or (4) as otherwise required by applicable law.

3. Public Disclosure

We will not publicly disclose your personal information, except: (1) to display desensitized information in connection with prize announcements or penalty notices; or (2) with your express consent.

4. Do Not Track

We do not use third-party tracking or advertising cookies. Accordingly, Do Not Track signals do not materially affect your experience on the Platform.

III. How We Store and Protect Your Personal Information

1. Storage Location and International Transfers

Our servers are located in the United States. If you access the Platform from outside the United States, your personal information will be transferred to and stored in the United States. We take measures to ensure an adequate level of protection for your personal information, including through data transfer agreements and, where required by applicable law, Standard Contractual Clauses approved by the European Commission.

2. Retention

We retain personal information for as long as your account relationship with us exists. Following the end of that relationship, we retain information for as long as necessary to maintain business records for audit purposes, comply with legal obligations, and address potential or existing legal claims. Once personal information is no longer necessary, we will delete or anonymize it.

3. Security

We implement appropriate technical, administrative, and physical measures to protect the information we collect against unauthorized access, use, disclosure, destruction, or alteration. Please be aware that no information security measures are perfect or impenetrable. In the event of a security incident, we will promptly notify you as required by applicable law.

IV. How You Manage Your Personal Information

1. Self-Determination to Receive Information

You may choose to follow or unfollow accounts at any time based on your preferences.

2. Access, Correction, and Deletion

You may access, correct, and delete your personal information through the Platform interface, including: profile information, account security information, privacy settings, and your posts, saved items, and liked content.

We will delete your personal information in any of the following circumstances: (1) the purpose of processing has been achieved or is no longer necessary; (2) we have stopped providing our products or services, or the retention period has expired; (3) you have expressly withdrawn your consent; (4) you have reasonable grounds to believe we are processing your personal information in violation of applicable law; or (5) as otherwise required by applicable law.

3. Withdrawal of Authorization

You may change or withdraw your authorization for certain data processing at any time through the Platform's settings or your device's operating system settings. Withdrawing authorization may result in the unavailability of some or all Platform features, and will not affect our prior processing based on your earlier authorization.

4. Automated Decision-Making

In some business functions, we may make decisions using automated systems including algorithms. If such decisions significantly affect your legal rights or interests, you have the right to request an explanation, and we will provide appropriate remedies.

V. How You Cancel Your Account

To delete your account, please send an email to contact@fengshuifans.com. We will process your request within 7 business days after verifying your identity.

After your account is cancelled, your personal information will be permanently deleted. Content you have published may be retained in anonymized form to maintain community integrity, unless you request its removal.

Please note: once your account is cancelled, unless otherwise required by law, we will not provide recovery of your account records, content, or virtual items. Please proceed with account cancellation with caution.

VI. Special Instructions on Third-Party Products and Services

The Platform may contain products and services provided by third parties, or provide links to third-party information and services. Any use of third-party services is subject to the terms of service and privacy policy of the relevant third party, and not this Policy. This Policy applies only to information we collect, store, use, share, and disclose.

VII. How We Use Cookies and Similar Technologies

We use only strictly necessary cookies to operate the Platform, including session cookies for authentication and security cookies used by Cloudflare Turnstile for bot protection. We do not use analytics or advertising cookies, and therefore do not display a cookie consent banner. You may disable cookies in your browser settings, but doing so may prevent you from logging in or using certain Platform features.

VIII. Protection of Minors

The Platform is not directed to children under the age of 13 (or under 16 in the EEA and UK). We do not knowingly collect personal information from children below these ages without the prior and verifiable consent of their parent or legal guardian.

If you are under 18 years of age, please read this Policy under the supervision and guidance of your parent or legal guardian, and only use the Platform after ensuring that your guardian agrees to the content of this Policy as required by applicable law.

If we discover that we have collected personal information from a child under the applicable minimum age without verified parental consent, we will take prompt steps to delete that information.

IX. How We Update This Policy

We may update this Policy from time to time to reflect new products, features, or legal requirements. We will not reduce your rights under this Policy without your express consent. We will notify you of material updates via in-app push notifications, email, or other reasonable means.

XI. Your Choices and Settings

You may update your privacy settings at any time to control notifications, communication preferences, and the sharing and visibility of your information on the Platform.

Your Content: You may edit or delete content you have published at any time. Content shared to third-party sites via the Platform's standard sharing features will be removed; however, we cannot control the deletion or modification of content that was manually shared by other users.

Email and Notifications: After creating an account, you may receive content digest emails and notifications about topics or accounts you follow. You may opt out of these through your email and notification settings. Transactional emails related to your account will continue to be sent.

Interactions with Other Users: You may adjust settings to limit who can send you messages or comment on your content.

Content and Topic Associations: You may change the topics or areas associated with your profile at any time.

Profile Information: You may update your displayed educational background and other profile information.

Account Deletion: To delete your account, please send an email to contact@fengshuifans.com. Your personal information will be permanently deleted. Content you have published may be retained in anonymized form to maintain community integrity, unless you request its removal.

Account Deactivation: When you select "Deactivate Account," you will not receive any communications, and other users will not be able to interact with you, but your content will remain on the Platform. You may reactivate your account by logging in at any time.

XII. Supplemental EEA+ Privacy Statement

This Supplemental EEA+ Privacy Statement applies to users located in the European Economic Area (EEA), the United Kingdom, and Switzerland (collectively, "EEA+"). It supplements our Privacy Policy and describes how we process your personal data in accordance with applicable data protection law. In the event of any inconsistency between this Statement and the main body of this Policy, this Statement prevails for EEA+ users.

Legal Bases for Processing

We process your personal data on the following legal bases:

  • Performance of a contract (Article 6(1)(b) GDPR): Where the processing is necessary to perform our contract with you, such as providing Platform Services and processing payments.
  • Compliance with a legal obligation (Article 6(1)(c) GDPR): Where the processing is necessary to comply with an applicable legal obligation under EEA or UK law.
  • Legitimate interests (Article 6(1)(f) GDPR): Where the processing is necessary for us to pursue a legitimate interest, including providing and improving Platform Services, maintaining Platform security and integrity, and managing our user community.
  • Consent (Article 6(1)(a) GDPR): Where we rely on your consent, such as when sending marketing or promotional emails. You may withdraw your consent at any time.

International Transfers

We may transfer your personal data to third parties located in the United States. We take measures to ensure an adequate level of data protection, including by implementing Standard Contractual Clauses (SCCs) approved by the European Commission where required.

If you are located in the EEA, UK, or Switzerland, you have the following rights under applicable data protection law:

XIII. Supplemental U.S. Privacy Statement

This Supplemental U.S. Privacy Statement applies to residents of California, Virginia, Colorado, Connecticut, Utah, Oregon, Texas, Montana, Delaware, Iowa, Nebraska, New Hampshire, and New Jersey. It supplements our Privacy Policy and describes our practices under applicable U.S. state privacy laws.

State Privacy Rights

Depending on your state of residence and subject to applicable law, you may have the following rights:

  • Right to request whether or not we are processing your personal data and to access such data;
  • Right to request correction of inaccuracies in your personal data;
  • Right to request deletion of personal data we have collected from or about you;

California Residents (CCPA)

The categories of personal information we collect correspond to the following categories under the California Consumer Privacy Act (CCPA):
